You do not need to have a fixed term tenancy agreement. You can have a week to week or month to month agreement but unless both parties agree on the leaving date you cannot start the fast track possession process until the agreement has lasted six months. Assured Shorthold Tenancy Agreement Our preference is for a six month Assured Shorthold Tenancy agreement. This means that you cannot make the tenant leave for six months and the tenant has to stay for six months. After the six months is up, if either party has not given the other party notice to quit the property then the tenancy is converted into a periodic tenancy agreement. Basically that means the agreement carries on and can now be cancelled by the tenant giving the landlord one months notice or the landlord giving the tenant two months notice. If you want your tenant to leave when the six months is up then make sure that you give them Notice to Quit two months beforehand. Our tried and tested Notice to Quit documents cost only £10. If you are unhappy with your tenant during the first six months of their lease then you can discuss an earlier leaving date with them. An unhappy tenant can be a nuisance tenant and it is always worth considering cutting the tenancy short if you think there may be damage or loss of rent. You CANNOT make them leave during this time and you should be very wary of doing anything that could be construed as harassment but sometimes the tenant wishes to leave. We have brought a tenancy agreement to an end in the past when a tenant had been made redundant and wished to move back with his parents. If the tenant does not wish to leave then you have no option but to go through the proper legal process to Evict your tenant.
